LEGISLATIVE ALERT - UPDATE: COBRA Undergoing Major Changes due to the 2009 Economic Stimulus Package
The American Recovery and Reinvestment Act of 2009 (ARRA) signed into law by President Obama on February 17, 2009 includes several important provisions affecting the workplace. The one provision relative to employees who are involuntarily terminated will have the most direct impact on almost every employer, as it explains how they will be able to continue their benefits through the Consolidated Omnibus Budget Reconciliation Act (COBRA).
The provisions of this new law offer two key benefits to employees who were terminated any time after September 1, 2008 and before December 31, 2009: a 65 percent subsidy of COBRA payments for up to nine (9) months and the ability to now elect COBRA if the election period has lapsed or select a lower level of coverage if the plan offers this option.
